Honorable Chief Justice Roberts:
I write to express extreme dismay at the inability of the Court to find and appropriately admonish the perpetrator(s) of the recent leak of Justice Alito’s draft decision regarding abortion. That act alone, unprecedented in our history, has in the eyes of many citizens disabled the Court’s ability to fairly adjudicate the highest questions facing our republic. The failure to find and hold accountable those highly qualified and privileged individuals who cast aside any future claims to personal honor or obedience to our Constitution in pursuit of political advantage has destroyed my faith, and that of many others, in the final institution defending our bulwark of freedom and our laws.
Most bodies of government at many levels have lost the confidence of our people. Congress remains at the bottom of the public’s ratings in polls. The FBI has insubordinately decided not to prosecute possible violations of national security, knowingly lied to the FISA courts, investigated what they knew to be a fabricated web of collusion between our Executive Branch and a foreign government, and refused to even-handedly evaluate possible violations of classified document safekeeping by two of our Presidents. The Department of Justice fails to act appropriately when its own OIG determines malfeasance by its upper echelon of officers. Multiple branches of government appear involved in censorship of the public’s political speech. CDC and FDA, under tutelage by a subordinate at the NIH, have persistently misguided the public regarding the evolving science of the Covid pandemic. The Department of Homeland Security refuses to enforce existing law and thus leaves our borders insecure, giving freedom of passage to not only political and economic refugees that we must support but also criminals and drugs that victimize our populace. Congress failed to protect the Capitol despite being given adequate warning and being offered 20,000 National Guard Troops for crowd control. Our police forces are financially disemboweled by local governments responsive only to a loud unlawful minority. Justices of the Supreme Court are directly threatened by the Senate Majority leader on the steps of the Court and are not kept safe in their own homes.
Our one center of gravity in all this entropy has been the Supreme Court. Yes, many past decisions deflected from the intents of our founders and the Constitution, but these have always been corrected. Historically, while the motives and reasoning of some Justices have been suspected, their integrity never has been. That impression of integrity may now evaporate due to a choice to elevate, honor, and trust some member of the Court’s staff who has betrayed the heart and soul of your Court. Should that person not be identified, disciplined, and removed from any future role in legal affairs before the bar, our trust in the Court will completely dissipate.
I urge you to immediately dismiss all those who admitted to violating signed confidence agreements by discussing the decision, or any decision, with spouses, partners, or others. Leaving them in place, while failing to find and punish the leaker(s), will embolden them and others to further indiscretions crippling the Court hereafter.
I further urge you to turn the investigation, unsatisfactorily completed by the Marshall of the Court, to the FBI. They may, despite having wandered far afield from their strictly defined role yet be able to identify the individual(s) involved. Especially if their investigation is not run by the Washington, D.C. headquarters. If that person(s) has violated law, please strongly consider holding any trial in the Supreme Court itself. Justice John Marshall Harlan provided precedent for this in the 19th century. These actions will go far towards restoring the peoples’ faith in the bedrock of our nation, the law.
